Cuttack: Orissa high court has dismissed a plea seeking quashing of an FIR against a man accused of attempt to murder and theft for concealing rejection of his anticipatory bail pleas by both the high court and Supreme Court.Observing that the petitioner had not approached it with “clean hands”, the HC also imposed a fine of Rs 50,000, directing him to deposit the amount in Odisha Chief Minister’s Relief Fund.Justice Sibo Sankar Mishra passed the order on a petition filed by Benudhar Pradhan, accused in a case registered at Fategarh police station in Nayagarh district.Pradhan is accused of offences under various provisions of Bharatiya Nyaya Sanhita (BNS), 2023. Investigation in the case is still underway and the matter is pending before the judicial magistrate first class (JMFC), Bhapur. The order issued on Oct 29 was uploaded on Nov 1.Pradhan had sought quashing of the FIR under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), which empowers high courts to exercise inherent powers to prevent abuse of the process of law and secure ends of justice. The HC pointed out that he filed the petition on Oct 21 without disclosing that his anticipatory bail plea had been rejected by the high court on Sept 10 and Supreme Court on Oct 16.When confronted with the omission, his counsel argued that the high court rules did not require disclosure of an earlier anticipatory bail rejection in an FIR-quashing petition.Rejecting the contention, Justice Mishra said it was “incumbent upon the petitioner to make a full and candid disclosure” of the earlier orders. The judge held that deliberate suppression of material facts alone was sufficient to warrant dismissal of the petition and warranted exemplary costs. The FIR involved Section 126(2) (wrongful restraint), Section 296 (obscene acts or songs), Section 118(1) (voluntarily causing hurt using dangerous weapons or means), Section 109(1) (attempt to murder), Section 61(2) (criminal conspiracy), Section 303(2) (theft) and Section 3(5) (joint liability for acts committed with common intention) of Bharatiya Nyaya Sanhita (BNS).
