The settlement ended Fox’s three-year legal battle, amid disagreements over property defects and disclosures made before purchase.

For all its picturesque charm, a dream home can sometimes conceal a nightmare behind its colourful walls and landscaped gardens. Hollywood actress Megan Fox learned the hard way after buying a sprawling Malibu property that she later said was plagued by mold, water damage and other costly defects. What started out as a multimillion-dollar real estate purchase eventually became a three-year legal battle, highlighting the dangers of buying luxury property even when it appears idyllic on the surface.

Controversial Malibu house of dreams

Fox purchased the four-bedroom Malibu property for $3.3 million in May 2016 from Cynthia Pett-Dante, longtime manager for actor Brad Pitt, Fox News and the Daily Mail reported. The home was in the Ramirez Canyon area of the gated community and had about 3,300 square feet of living space on a two-acre estate. It wasn’t just the interiors that appealed. According to Realtor, the home had colorful finishes, unique wallpaper, decorative tiles, and a bohemian vibe. The grounds featured fruit trees, a greenhouse, stone walls, winding trails and small bridges. Outdoor amenities included a swimming pool, sports court and an in-ground trampoline. But the beautiful surroundings apparently masked serious problems. Fox later said the property had mold, leaks and water damage and estimated the cost of fixing the problems at more than $500,000.

$5 million lawsuit, health claims

In 2018, roughly two years after the purchase, Fox sued Pett-Dante and others associated with the transaction for $5 million. Fox News and the Daily Mail reported that the actress claims the condition of the property caused chronic migraines, stress and other health problems. The lawsuit also questioned water damage, problems with the septic tank and structures on the property that Fox claimed were not properly permitted. Another concern, according to court documents, was extensive landscaping and animal facilities allegedly built to house rescued animals. But the dispute was over conflicting accounts of what had been disclosed before the sale. Pett-Dante’s lawyers said Fox and her representatives were told about a number of defects before going ahead with the purchase, the Daily Mail reported. Court documents also revealed that Fox’s real estate lawyer had expressed serious reservations about the transaction. In testimony, Fox admitted she hadn’t read certain emails, inspection reports and disclosures herself, relying on professionals to review documents and advise her. She went ahead with the purchase, the reports said, as it was within her budget and would put her children into a school district she liked.

Legal battle ends in settlement

The dispute ended in 2021 when Fox reportedly agreed to a $100,000 settlement offered by Pett-Dante under California’s settlement-offer provisions, according to the Daily Mail and Fox News. The amount was well short of the $5 million initially sought in damages. The settlement opened the door to dismiss the case with prejudice, ending the three-year legal battle. The court proceedings had also revealed the disagreement about the extent of the property’s defects and what the buyers knew before the sale.

The house goes back on the market

But the Malibu residence still drew real estate interest despite its legal history. The home was listed in April 2021 for $4.65 million and went into contingent sale status, the realtor said. The Daily Mail report adds that its return to the market has sparked fresh questions about the importance of property disclosures, particularly when a home has been linked to allegations of mold and water damage.Fox’s experience is a reminder that luxury real estate is more than simply location, architecture and beautiful scenery. Even for what appears to be the ideal Hollywood hideaway, comprehensive inspections, a close examination of disclosures and a solid knowledge of possible repair costs are critical.Images Courtesy: istock and Wikipedia
